ORDER ON DEFENDANTS' UNOPPOSED MOTION FORENLARGEMENT OF DEADLINE

The Defendants' Unopposed Motion for Enlargement of Deadline toAnswer or Otherwise Respond to the Second Amended Complaint isGRANTED, but with this notice to counsel. I do not expect thisdelay to play any part in the schedule for discovery. There has alreadybeen extensive delay in discovery occasioned by the motion practice onthe First Amended Complaint and resulting decision time. Several statecourts are holding their cases in abeyance pending resolution of themulti-district proceedings. It is essential that the proceedings heremove forward now with alacrity.

In light of one of the new counts of the Second Amended Complaint andthe reference to it in the motion for enlargement, I also disclose that Iam one of the Advisers on the current American Law Institute project toprepare a Restatement (Third) of Restitution and UnjustEnrichment.
